Terms of Service

Draft for counsel review. Not in force. This text has not been reviewed by a lawyer and binds no one. Items in [square brackets] are open questions for counsel.

1. Who may use Cari

You must be at least 18 years old [counsel: confirm the minimum age]. You sign in to the Cari rider or driver app with your phone number and a one-time code we text you. Keep your phone and your account to yourself, and tell us at support@ridecari.com if you lose access.

2. What Cari is

Cari is a platform that connects riders with drivers. Drivers provide the rides. Cari does not drive and does not employ drivers as drivers of the rides they accept [counsel: confirm the relationship wording]. Cari is pre-launch and has not yet been licensed as a transportation network company; nothing here promises that rides are available.

3. Fares

Inside Cari's fixed-price zones, a ride has one fixed price for the pair of places, and you see it before you request. Elsewhere you name your own price and drivers can accept it or counter. The price you agree is the fare for that trip.

Your receipt lists the fare and each fee line separately, with the trip details California requires. Fees that apply to your trip are shown to you before you confirm.

4. Payment

Riders pay by card, through our payment processor, Stripe. You authorize Cari to hold and charge your card for the agreed fare, any fees, any cancellation fee and any tip. If Cari offers credit or a wallet balance, it is applied before your card, and its separate terms will be added here [counsel: wallet and credit terms]. Drivers are paid through Stripe Connect.

5. Cancellations

You can cancel a ride you have requested. After a driver has accepted it and a short grace period has passed, or if you are not at the pickup when the driver arrives, a cancellation fee may apply. The amount and the grace period are shown in the app before you are charged [counsel: fee wording].

6. Tips

After a trip, a rider can add a tip by card. The tip goes to the driver [counsel: confirm how any processing cost is described].

7. Conduct and zero tolerance

Treat drivers and riders with respect. Do not use Cari for anything unlawful, or to harass, threaten or harm anyone. Cari has a zero-tolerance policy for drivers who use drugs or alcohol while logged in; a driver reported for it is suspended at once. Read it, and how to report, on our zero-tolerance page.

8. Safety and support

In an emergency, call 911. To report a problem with a trip, open the trip in the app and tap Report a problem, or email support@ridecari.com. You can also contact the California Public Utilities Commission Consumer Intake Unit at 1-800-894-9444 or CIU_intake@cpuc.ca.gov.

9. Texts and notifications

We text you a code to sign in, and we send trip updates as push notifications. Message and data rates from your carrier may apply [counsel: add the required text-message disclosures, including how to opt out].

10. Privacy

How we handle your information is described on our privacy page.

11. Accounts and ending them

You can stop using Cari at any time. We may suspend or close an account for breaking these terms, for safety reasons, or if the law requires it. Charges already incurred still apply.

12. Disclaimers and limits of liability

Cari is provided "as is" and "as available". To the fullest extent the law allows, Cari is not liable for indirect or consequential losses, and its total liability to you for any claim is limited to [counsel: amount]. Nothing here limits liability that the law does not allow to be limited, or any insurance coverage California requires for a ride.

13. Disputes and governing law

California law governs these terms. [Counsel: dispute process, arbitration, class-action waiver, venue.] To dispute a charge, email support@ridecari.com first.

14. Changes to these terms

We may change these terms. We will post the new version here and tell you in the app before it takes effect. Using Cari after that means you accept it.
